Throughout the Eurozone, there is wide variability in how the laws handle the increasing incidence of the need for making – decision – making (MDM) for cognitively impaired elders. In some European jurisdictions, when the wishes of the decisionally -cognitively impaired person have nevernot been documented, there is an Informalinformal or unofficial representation of a person, not designated by a court or by the patient himselfthemselves, that takesmakes medical decisions on the patient’s behalf in casecases of his incompetence. If the law provides for this, the next of kin are usually allowed to act in such a capacity .
